These Terms of Service ("Terms") govern your access to and use of the www.whyeva.com website and the WhyEva automated video screening platform (the "Platform"), operated by ENSIFERA ("we", "us", or "our").
By accessing or using our Platform, whether as a Recruiter (Client) or a Candidate (User), you agree to be bound by these Terms.

WhyEva provides an asynchronous video interview and screening tool.
The Platform utilizes Artificial Intelligence (AI) and Large Language Models (LLMs) to transcribe audio, detect potential cheating, and rank candidate responses based on relevance to the Recruiter's criteria.
Important: WhyEva does not make any automated hiring decisions. The AI acts solely as a decision-support tool. The final hiring decision rests entirely and exclusively with the Recruiter. We disclaim any liability regarding the final recruitment choices made by our Clients.
Users are solely responsible for the content they submit, including videos, audio, and CVs. By submitting a video, Candidates consent to its transmission to the respective Recruiter and its semantic analysis by our systems. Recruiters agree to use Candidate data strictly for recruitment purposes and in compliance with applicable data protection laws.
All content, features, and functionality of the Platform (including but not limited to design, text, logos, and software) are the exclusive property of ENSIFERA and are protected by international copyright and intellectual property laws.
These Terms shall be governed by and construed in accordance with the laws of France. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Metz, France.
